By purchasing any product (a “Product”) from Lightyear Coffee LLC “Lightyear”, “we”, “us” and “our”), you (“your” or “yours”) agree to the following Terms of Purchase, which govern all transactions on our website, https://lightyearcoffee.com. These Terms of Purchase are part of and subject to our full Terms of Use.
Delivery and Access. Once payment is confirmed, the Product will be available in the timeframe indicated on our website. In general, 1) a non-customized digital Product will be available for one direct download immediately following a payment transaction and will be available for a period of 10 days, and 2) a customized digital Product will be emailed by us to the email address you provided at checkout within 3-5 business days following a payment transaction. We reserve the right in our sole discretion to refuse access, cancel the download, or cancel your order if you violate these Terms of Purchase or our Terms of Use. For a Product that includes a consultation with us, we will coordinate with you via email about a mutually agreeable day, time, and format (i.e. in-person, phone, Zoom, Teams, Google) for the consultation. We will make every effort to complete the consultation within a reasonable amount of time following your purchase.
Payment & Refund Policy. All sales are final. We do not offer refunds, exchanges, or cancellations once an order has been placed. If you do not receive the Product within the expected 3-5 business day timeframe, please check your spam folder and then contact us at julian@lightyearcoffee.com. We will re-send the Product if necessary.
Product Format & Compatibility. A digital Product will be downloaded or delivered as a PDF (Portable Document Format). You must have Adobe Acrobat Reader or another PDF-compatible software to access the Product. It is your responsibility to ensure that you have the necessary hardware and software to access and use the Product before purchasing. If you experience technical issues accessing the Product, we will make reasonable efforts to assist but are not responsible for your inability to access it due to incompatible devices, outdated software, or other technical limitations on your end.
License and Usage Rights. Upon purchase, you are granted a non-exclusive, non-transferable license to use the Product for personal, informational use only. You may not modify, reverse engineer, reproduce, resell, redesign, or redistribute the Product in whole or in part, in any form by any means, without the prior written consent of Lightyear. A purchase does not automatically include continuing access or any subsequent access to new Product updates and versions.
No Professional Advice; No Warranties. The contents of a Product are provided for informational purposes only and should not be considered professional, financial, legal, tax, or business advice. You are solely responsible for how you interpret and use the information, all of which is at your own risk.
Lightyear Coffee incurs no liability, duty or obligation for or in connection with the content of a Product, any other related information (including for any errors, inaccuracies, omissions or delays in the data) and/or any actions taken in reliance thereon. The Product is sold “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Product will meet your expectations or achieve any specific outcome. Purchase of a Product does not establish a professional-client relationship with Lightyear.
Limitation of Liability. To the maximum extent permitted by law, our total liability for any claim related to your purchase or use of the Product shall not exceed the total amount you paid for that Product. Additionally, to the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or reputational harm, even if we have been advised of the possibility of such damages.
Governing Law & Dispute Resolution. These Terms of Purchase are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the courts of Delaware, unless otherwise required by law.
Privacy. We do not share any of your information with any other party, except in the following cases: (a) If you authorize us to do so; (b) We are required by law to do so; (c) In the aggregate to third party advertisers and partners. This information is not linked to any personally identifiable information; (d) To provide services such as email newsletter delivery. The companies that provide these services for us may not retain, share, store or use personally identifiable information for any secondary purposes.
We use cookies in connection with our Services. A “browser” or “HTTP” cookie is a unique text file that may be used for data analysis, and enables a web site to tailor information presented to a user based on a user’s browsing program.
